En effet, une partie des terres agricoles en copropri\u00e9t\u00e9 a \u00e9t\u00e9 pr\u00e9c\u00e9d\u00e9e par un plan de construction mis de c\u00f4t\u00e9 apr\u00e8s l\u2019approbation du plan directeur r\u00e9gional TAMAM 21. Ce plan a chang\u00e9 la d\u00e9signation de vastes terres agricoles du district central en une r\u00e9serve dont la construction est interdite.<\/p>\n<p>Il s\u2019agit d\u2019un terrain de 530 dounams situ\u00e9 entre le kibboutz et la route c\u00f4ti\u00e8re, dont une partie a \u00e9t\u00e9 promue dans les ann\u00e9es 90 par un plan modifiant la d\u00e9signation de 50 dounams de la terre, de l\u2019agriculture \u00e0 la construction de commerce, d\u2019emplois et d\u2019industrie. Le plan a \u00e9t\u00e9 promu par le comit\u00e9 local de planification et de construction de Hof Hasharon et a \u00e9t\u00e9 d\u00e9pos\u00e9 en 1998 aupr\u00e8s du comit\u00e9 de district du district central. Aucune objection n&#8217;a \u00e9t\u00e9 formul\u00e9e. Plus tard, le plan a \u00e9t\u00e9 promu par les institutions de planification sup\u00e9rieures, lorsqu&#8217;il a \u00e9t\u00e9 d\u00e9cid\u00e9 qu\u2019il \u00e9tait inappropri\u00e9 de promouvoir un plan de construction sur le terrain. Entre-temps, TAMAM 21, qui a d\u00e9sign\u00e9 le terrain comme r\u00e9serve naturelle, a \u00e9t\u00e9 approuv\u00e9 en 2003, Le comit\u00e9 de district a ainsi rejet\u00e9 l&#8217;ensemble du plan.<\/p>\n<p>Apr\u00e8s l&#8217;approbation du plan qui d\u00e9signait les terres pour la r\u00e9serve, le Kibboutz Ga&#8217;ash a pr\u00e9sent\u00e9 une demande d&#8217;indemnisation p\u00e9cuniaire, qui a \u00e9t\u00e9 rejet\u00e9e par le comit\u00e9 local. Le kibboutz, \u00e0 l&#8217;instar de dizaines d&#8217;autres propri\u00e9taires terriens du district central dont les demandes ont \u00e9t\u00e9 rejet\u00e9es par les comit\u00e9s locaux, a interjet\u00e9 appel du comit\u00e9 d&#8217;appel du district, affirmant qu&#8217;il m\u00e9ritait une compensation financi\u00e8re. Le comit\u00e9 d\u2019appel, pr\u00e9sid\u00e9 par le pr\u00e9sident de l\u2019\u00e9poque, Micha Gidron, a rejet\u00e9 les dizaines d\u2019appels interjet\u00e9s par les propri\u00e9taires fonciers dans chaque district central, affirmant qu\u2019ils m\u00e9ritaient une indemnisation p\u00e9cuniaire apr\u00e8s avoir envisag\u00e9 de modifier la d\u00e9signation de leurs terres agricoles. Dans ce contexte, en 2013, le comit\u00e9 de recours a partiellement accept\u00e9 l&#8217;appel interjet\u00e9 par le kibboutz Gaash concernant une partie de la division fonci\u00e8re partag\u00e9e par le kibboutz Veloscom.<\/p>\n<p>Contre la d\u00e9cision du comit\u00e9 d&#8217;appel, en 2016, le comit\u00e9 local de planification et de construction de Hof Hasharon a form\u00e9 un recours devant le tribunal de district, all\u00e9guant que le plan propos\u00e9 sur le terrain ne justifiait pas une indemnisation, m\u00eame partielle, du kibboutz Gaash. De son c\u00f4t\u00e9, le Kibboutz Gaash a d\u00e9clar\u00e9 que l&#8217;appel du comit\u00e9 local devait \u00eatre rejet\u00e9 et que le plan qui l&#8217;avait pr\u00e9c\u00e9d\u00e9 cr\u00e9ait des attentes raisonnables quant au zonage de l&#8217;un des lots aux fins de construction. Il a \u00e9galement \u00e9t\u00e9 affirm\u00e9 que le plan qui avait \u00e9t\u00e9 pr\u00e9c\u00e9d\u00e9 n\u2019\u00e9tait pas au stade initial, mais avait \u00e9t\u00e9 beaucoup plus pouss\u00e9 que celui de la cour en question. En outre, le Kibboutz Ga&#8217;ash a affirm\u00e9 que l&#8217;objection soulev\u00e9e par HOLANAT contre le plan ne concernait que le lot pour lequel il avait \u00e9t\u00e9 d\u00e9cid\u00e9 de ne pas promouvoir la construction.<\/p>\n<p>Le procureur g\u00e9n\u00e9ral s&#8217;est \u00e9galement joint \u00e0 l&#8217;appel, arguant qu&#8217;il \u00e9tait impossible de r\u00e9parer les dommages caus\u00e9s par la perte de potentiel de modification du zonage, m\u00eame s&#8217;il y avait eu une proc\u00e9dure pr\u00e9coce dans les institutions de planification.<br \/>\n&#8220;Le potentiel de planification est vraiment endommag\u00e9&#8221;<br \/>\nLe juge Zahava Bustan, du tribunal de district central, a d\u00e9cid\u00e9 de rejeter l&#8217;appel du comit\u00e9 local ainsi que la position du conseiller juridique et de laisser la d\u00e9cision du comit\u00e9 d&#8217;appel intacte. Bustan a accept\u00e9 la position du kibboutz Gaash selon laquelle l&#8217;une des parcelles pour lesquelles le plan \u00e9tait promu avait \u00e9t\u00e9 endommag\u00e9.<\/p>\n<p>Bustan \u00e9tait \u00e9galement d&#8217;accord avec la d\u00e9cision du comit\u00e9 d&#8217;appel selon laquelle, sans l&#8217;approbation de Tamam 21, il y avait une chance raisonnable que le plan qui modifierait la d\u00e9signation de l&#8217;un des lots du programme d&#8217;agriculture industrielle soit approuv\u00e9 et que l&#8217;objection de la PNL se r\u00e9f\u00e8re au lot suppl\u00e9mentaire, pas aux deux parcelles. &#8220;Dans ces circonstances&#8221;, a d\u00e9clar\u00e9 Bustan au tribunal en question, &#8220;il existait un potentiel de planification r\u00e9el qui a \u00e9t\u00e9 endommag\u00e9 avec l&#8217;approbation de NAM 21, comme l&#8217;a d\u00e9termin\u00e9 le comit\u00e9 d&#8217;appel.&#8221;<\/p>\n<p>Au m\u00eame moment, Bustan a re\u00e7u un appel interjet\u00e9 par le kibboutz Gaash et Sakum concernant le montant de l\u2019indemnit\u00e9 qui leur \u00e9tait due. Bustan a d\u00e9termin\u00e9 que le cas serait renvoy\u00e9 au vaste \u00e9valuateur, de sorte que le taux de dommages caus\u00e9s \u00e0 la parcelle en question serait calcul\u00e9 ind\u00e9pendamment du potentiel \u00e9conomique du terrain.
